Correspondingly, DHS also amended the heavily weighted factor to state an alien’s receipt, being certified to receive, or approval to receive one or more public benefits, as defined, for more than 12 months within any 36 month period, beginning from 36 months prior to the alien’s application for admission or adjustment of status, will be considered a heavily-weighted negative factor in the totality of the circumstances assessment.
