To think in this manner is to ignore the impact of the past human experience of Aboriginal people. Their self-determination has been denied and suppressed, social disorganization has been the consequence, and they are unable to accept the “white man’s solution” any longer. There must be a drastic shift in thinking about power and authority. The federal and provincial governments and their officials have to accept that Aboriginal people must have the necessary power and authority to govern themselves in this area. Impediments to the exercise of such power and jurisdiction must be removed. We are unable to define with certainty at this point how far that development needs to proceed in order to turn the tide of tragedy we see, but we are satisfied enough to state that we believe that the right of Aboriginal people to establish and maintain their own justice systems within their own communities, free from interference from
